These Terms of Use ("Terms") govern your access to and use of the website at adam.gohireretire.com, the Adam AI assistant service, related tools, and any associated content, webinars, or training materials (collectively, the "Service"). By accessing or using the Service, creating an account, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Adam is an AI-powered assistant designed to help real estate agents manage leads, schedule follow-ups, and streamline client communications via SMS and other channels. The Service may include:
The Service uses artificial intelligence, including large language models, to generate text messages, suggestions, and other content. You acknowledge and agree to the following:
By using the Service and providing your phone number, you expressly consent to receive automated text messages (SMS and MMS), phone calls, and pre-recorded messages from GoHireRetire and the Adam platform at the phone number you provide. This consent applies to messages related to:
Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message or by contacting us at support@adam-ai-agent.com. Opting out of SMS does not cancel your subscription.
Your use of Adam to send SMS. When you use Adam to send automated messages to your own leads and clients, you are the sender of those messages. You are solely responsible for obtaining proper consent from your recipients in compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any other applicable federal, state, or local laws. You agree to maintain records of consent and to honor all opt-out requests promptly. GoHireRetire is not liable for any claims arising from messages you send through the Service without proper recipient consent.
Access to the Adam platform requires a paid subscription. By subscribing, you agree to the following:

Your content. You retain ownership of the data and content you upload to the Service. By using the Service, you grant us a limited, non-exclusive license to process your content as necessary to provide the Service. This license terminates when you delete your content or close your account.
AI-generated output. Messages, suggestions, and other content generated by the AI based on your inputs are provided for your use within the scope of the Service. You may use AI-generated content in your business communications. We make no claim of ownership over AI-generated output created from your specific inputs.
The Service may integrate with or contain links to third-party services, including but not limited to payment processors, CRM platforms, messaging carriers, and analytics tools. We are not responsible for the content, terms, privacy practices, or availability of any third-party services. Your use of third-party services is governed by their respective terms and policies.
We strive to maintain consistent uptime, but we do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.
We reserve the right to modify, update, or discontinue any feature or aspect of the Service at any time. If a material change significantly reduces the functionality of your current plan, we will provide reasonable notice.
To the maximum extent permitted by applicable law, GoHireRetire, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Informal resolution first. Before initiating any formal dispute, you agree to contact us at support@adam-ai-agent.com and attempt to resolve the matter informally for at least 30 days.
Binding arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Orange County, Florida, or remotely if permitted by the arbitrator.
Class action waiver. You agree that disputes will be resolved on an individual basis. You waive the right to participate in any class action, class arbitration, or representative proceeding.
Small claims exception. Either party may bring an individual claim in small claims court if the claim falls within that court's jurisdictional limits.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Orange County, Florida.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, non-payment, fraudulent activity, or conduct that harms other users or the integrity of the Service.
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including liability limitations, indemnification, dispute resolution, and intellectual property provisions) will remain in effect.
We reserve the right to update these Terms at any time. If we make material changes, we will notify active subscribers via email or through the Service at least 15 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must cancel your subscription and stop using the Service.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoHireRetire regarding the use of the Service. These Terms supersede any prior agreements or understandings, whether written or oral.
